This policy forms part of the Terms of Service.
Words with capital letters, such as Account, Authorized User, Customer, Customer Content, Customer Platform, Services and End User, have the meanings given in the Terms of Service (vodlix.com/terms-of-service). Sections 1 to 7 set out what Customers may and may not do, and in those sections "you" means the Customer. Sections 8 to 20 explain how anyone can report content to us and how we handle reports, and in those sections "you" means the person reporting, appealing or affected, as the context requires.
1. The principle
Vodlix supports a broad range of lawful content. We do not restrict Customers by genre, viewpoint or subject matter, and we do not pre-screen. What follows are the limits, and they exist because content of these kinds causes real harm or is unlawful.
2. Prohibited content
You may not upload, publish, distribute or make available content that:
Unlawful and severely harmful
sexually exploits or endangers a child, or depicts a minor in a sexualized manner, in any form, real or synthetic;
promotes, facilitates, glorifies or instructs in terrorism or violent extremism, or supports a proscribed organization;
incites, threatens or promotes violence against any person or group;
depicts real extreme violence, torture or serious cruelty to animals, other than in a genuine news, documentary, educational or scientific context;
promotes or facilitates self-harm, suicide or disordered eating;
Harm to people
attacks, degrades or promotes hatred against people on the basis of race, ethnicity, national origin, religion, caste, sex, gender, gender identity, sexual orientation, disability, age or serious disease;
harasses, bullies, threatens or targets an individual, or discloses private information about a person without consent;
depicts a real, identifiable person in intimate or sexual content without their consent, including synthetic or manipulated depictions;
impersonates a person or organization, or misrepresents affiliation;
Rights of others
infringes any copyright, trade mark, patent, trade secret, moral right, right of publicity, database right or other right, including streaming or redistributing content, live events or broadcasts you are not licensed to distribute;
uses music or other third-party material without the necessary licenses;
Deception, crime and platform integrity
facilitates fraud, deceptive commercial practice, illegal gambling, or the sale of illegal goods or controlled substances;
instructs in the construction of weapons or explosives;
contains malware or phishing, or code intended to damage or gain unauthorized access to any system;
circumvents, or is designed to circumvent, technical protection measures, access controls, geographic restrictions or content filtering;
breaches any applicable law, regulation, sanctions regime or export control.
3. What is allowed
Outside the categories above, we do not restrict content by genre, format or subject matter. Drama, documentary, news, sport, faith, education, fitness, music, comedy, live events, adult-oriented entertainment for adult audiences, and anything else lawful may be distributed through the Services.
Where content is lawful but unsuitable for minors, clause 4 applies.
4. Prohibited conduct
You may not: interfere with or disrupt the Services or other Customers' use of them; probe, scan or test the security of the Services without our written permission; use automated means to access the Services other than through our documented APIs and within published limits; circumvent usage limits, billing or access controls; use the Services to send unsolicited bulk email; or resell the Services other than as your own Customer Platform.
Your Authorized Users and End Users. You must not allow anyone who uses your Customer Platform, including your Authorized Users and your End Users, to use it in a way this policy prohibits. Content they upload or post through your Customer Platform is treated as Customer Content for the purposes of this policy, and you are responsible for acting on it.
5. Age-restricted content
Where content is lawful but unsuitable for minors, you are responsible for:
(a) applying effective age assurance before access, to the standard the law of each territory you serve requires, which for some content and some territories means highly effective age verification, not a self-declared date of birth;
(b) classifying and labeling the content;
(c) keeping any records the law requires of you, including performer age and consent records where applicable; and
(d) geo-restricting where a territory prohibits the content.
We provide access-control tools. Configuring them correctly, and meeting the obligations that apply to you, is yours. Your indemnity under clause 15 of the Terms of Service applies to your content whatever its type.
6. Reporting
Report a breach of this policy to [email protected]. Report copyright infringement under the Copyright Policy (vodlix.com/copyright).
7. Enforcement
We may remove or disable content, suspend a Customer Platform, or terminate an Account, proportionate to the breach. Except where the breach is severe or unlawful, or where the law requires immediate action, we will tell you first and give you a reasonable chance to fix it.
We will tell you what we did and why, and you may respond to [email protected]. We will consider a response in good faith and reverse our action if it was wrong.
8. What Vodlix is
Vodlix is a hosting platform. Customers operate their own branded streaming services on our infrastructure, choose their own content, and are responsible for it.
We do not pre-screen content, and we do not monitor generally. We act on notice.
9. Reporting content
Anyone may report: you do not need an account, and you do not need to be affected.
What | Where |
|---|---|
Illegal content, or content breaching the Acceptable Use Policy | |
Copyright infringement | [email protected] (see the Copyright Policy, vodlix.com/copyright) |
Child sexual abuse material | [email protected], marked URGENT: CSAM |
9.1 What to include
Where it is: the URL or enough to locate it
What is wrong with it, and why you believe it is illegal or breaches our rules
Your name and email, so we can tell you the outcome (not required for reports of child sexual abuse material)
A statement that your report is accurate and made in good faith
Reports may be submitted in any of the languages this policy is published in.
9.2 Anonymous reports
We accept them. We will act on them, but cannot tell you the outcome.
10. What we do with a report
10.1 Acknowledgment
We acknowledge within one business day, with a reference.
10.2 Assessment
We assess without undue delay, considering what is reported, the applicable law, the Acceptable Use Policy, and whether the material is manifestly illegal.
We may ask the Customer for context, except where doing so would risk harm, prejudice an investigation, or where the content is child sexual abuse material.
10.3 Timescales
Category | Target |
|---|---|
Child sexual abuse material | Immediately: removal and preservation on identification |
Terrorist content | Within 1 hour of a valid competent-authority order, otherwise as fast as possible |
Other manifestly illegal content | Within 24 hours |
Other reports | Within 5 business days |
10.4 What we may do
Take no action; remove or disable the content; restrict its availability in particular territories; suspend the Customer Platform; terminate the account; or refer to law enforcement.
We act proportionately. Removing one video is preferred to suspending a service where that addresses the problem.
11. Statements of reasons
Where we remove or restrict content, or restrict an account, we give the Customer a statement of reasons, including:
(a) what we did, and whether it affects the content, its visibility, monetization or the account;
(b) the facts we relied on, and whether they came from a report or our own detection;
(c) whether automated means were used (we do not currently use automated detection);
(d) the legal ground or the term of our terms relied on, and why;
(e) the territorial scope; and
(f) how to appeal (see §12).
We give it without undue delay, and no later than when the action takes effect where practical.
We also tell the reporter what we decided, where they gave contact details.
12. Appeals
Either the Customer or the reporter may appeal, within 6 months, to [email protected] (routed to [email protected]).
We handle appeals without undue delay, in a non-discriminatory, diligent and non-arbitrary way, and not solely by automated means. Where an appeal shows we were wrong, we reverse the decision promptly and tell both parties.
An appeal is decided by a different member of our Trust & Safety team from the one who made the original decision.
Nothing here removes your right to go to court or, in the EU, to an out-of-court dispute settlement body.
13. Child sexual abuse material
This is the one category with no discretion and no notice to the Customer.
Our Trust & Safety team handles every report of CSAM. On identifying, or receiving a credible report of, CSAM, we will:
remove or disable access immediately;
preserve the material and associated data securely, in a form that supports a criminal investigation, and not delete it merely because it was removed;
report to the appropriate authority: in the UK, the National Crime Agency (NCA) and the Internet Watch Foundation (IWF); in the United States, the National Center for Missing & Exploited Children (NCMEC);
suspend the account immediately, without prior notice; and
cooperate fully with law enforcement.
We will not notify the Customer before acting, and we will not restore the material on request.
Nobody at Vodlix may view suspected CSAM beyond what is strictly necessary to confirm and report it.
14. Threats to life or safety
Where we become aware of information giving rise to a suspicion that a criminal offense involving a threat to the life or safety of a person has taken place, is taking place or is likely to take place, we will promptly inform the law enforcement or judicial authorities of the country or countries concerned and give them the relevant information available to us. We may do so without first notifying the Customer.
15. Repeat breaches
Customers who repeatedly breach the Acceptable Use Policy have their accounts terminated. Copyright repeat infringement is handled under the Repeat Infringer Policy in our Copyright Policy (vodlix.com/copyright); other categories are assessed on seriousness and frequency.
We may suspend or terminate immediately for content in §13, terrorist content, or where continuing risks serious harm.
16. Misuse of reporting
Submitting reports that are manifestly unfounded, repetitive or in bad faith may lead us to suspend processing your reports for a reasonable period, after warning you.
We do the same for Customers who repeatedly submit manifestly unfounded appeals.
17. Orders from authorities
Where we receive an order from a competent authority to act against content or to provide information, we act as required, and inform the Customer of the order and its effect unless the order or the law prohibits it.
We tell the authority what we did, and when.
18. Transparency
We keep internal records of every report, decision, statement of reasons and appeal for 3 years, as evidence that this policy is applied.
19. Changes to this policy
We may update this policy. Because it forms part of the Terms of Service, changes are made and notified under clause 21 of the Terms of Service, and we will post the updated policy here with a new date. We may make a change with immediate effect where we must do so to comply with the law or an order of a competent authority, or to address an unforeseen and imminent risk to End Users, users or the Services, and we will tell Customers as soon as we can.
