This policy forms part of the Terms of Service.

Words with capital letters, such as Account, Customer, Customer Content, Customer Platform and Services, have the meanings given in the Terms of Service (vodlix.com/terms-of-service). "DMCA" means the United States Digital Millennium Copyright Act, including 17 U.S.C. §512. In this policy, "you" means the person sending a notice or counter-notice or, where the context requires, the Customer concerned.

1. Designated agent

We have designated an agent to receive notifications of claimed infringement, registered with the United States Copyright Office:

Yousaf Rasheed

Fast OTT Ltd (trading as Vodlix)

Office 7, 480 Larkshall Road, London, England, E4 9HH

Telephone: +44 20 3769 2561

Email: [email protected]

2. Submitting a notice

A notice must include:

(a) a physical or electronic signature of the copyright owner or a person authorized to act for them;

(b) identification of the work claimed to be infringed;

(c) identification of the material claimed to be infringing, with enough information for us to locate it;

(d) your name, address, telephone number and email;

(e) a statement that you have a good-faith belief the use is not authorized by the owner, its agent or the law; and

(f) a statement, under penalty of perjury, that the information is accurate and that you are the owner or authorized to act for them.

Before you send a notice, please consider whether the use of the material may be permitted by law, for example as fair use under United States law or under a copyright exception such as fair dealing under United Kingdom law. If you are not sure whether material infringes your rights, you may wish to take legal advice before sending a notice.

3. What we do

We act expeditiously to remove or disable access to material that is the subject of a valid notice, tell the Customer what was removed and why, and record a strike under section 9.

4. Counter-notice

If you believe material was removed by mistake or misidentification, send a counter-notice to the agent above containing: your signature; identification of the material and where it appeared; a statement under penalty of perjury that you believe in good faith it was removed by mistake or misidentification; and your name, address and telephone number, your consent to the jurisdiction of the federal court for that address (or, if outside the United States, any judicial district in which we may be found), and your consent to accept service of process from the party who sent the notice.

We will forward a valid counter-notice and may restore the material in not less than 10 and not more than 14 business days, unless the party who sent the notice tells us it has filed an action seeking a court order.

5. Reports from outside the United States

You may report infringement to the same address whether or not you are in the United States, and whether or not the DMCA applies. We handle every report under this policy.

Where your report relies on the law of a country other than the United States, it does not need to include the statement under penalty of perjury in section 2(f). It must include the other information listed in section 2 and a statement that you believe in good faith that the information in your report is accurate and complete. We apply the law your report relies on, and the Customer, or you, may challenge our decision through a counter-notice under section 4 or through the appeals process in the Acceptable Use Policy (vodlix.com/acceptable-use).

6. Misuse

Submitting a notice or counter-notice that materially misrepresents that material is infringing, or was removed by mistake, may result in liability for damages, including under 17 U.S.C. §512(f).

7. Information we share

When we act on a notice, we send a copy of it, including the name and contact details it contains, to the Customer whose content it concerns, so that the Customer can respond to it. When we receive a valid counter-notice, we send a copy of it, including the name, address and telephone number it contains, to the person who sent the original notice. We handle personal data in notices and counter-notices as described in our Privacy Policy (vodlix.com/privacy-policy).

8. Changes to this policy

We may update this policy. Because it forms part of the Terms of Service, changes are made and notified under clause 21 of the Terms of Service, and we will post the updated policy here with a new date. We may make a change with immediate effect where the law requires it, and we will tell Customers as soon as we can. If the details of our designated agent change, we will promptly update section 1 and our filing with the United States Copyright Office.

9. Repeat Infringer Policy

9.1 Commitment. We maintain and reasonably implement a policy of terminating, in appropriate circumstances, the accounts of Customers who repeatedly infringe copyright or other intellectual property rights.

9.2 Strikes. A Customer receives one strike when content it uploaded is removed or disabled following a valid notice of claimed infringement.

A strike is not recorded, or is withdrawn if already recorded, where:

(a) the complaining party retracts the notice;

(b) the Customer submits a valid counter-notice and the material is restored;

(c) we determine the notice was invalid, abusive, or did not substantially comply with section 2; or

(d) the removal resulted from our own error.

Multiple items in a single notice, or in several notices arising from the same claim received at substantially the same time, count as one strike.

9.3 Threshold. A Customer who accumulates three strikes in any rolling 12-month period will have their Account terminated.

9.4 Expiry. A strike stops counting toward the threshold 12 months after it is recorded.

9.5 Immediate termination. We may terminate without regard to the threshold where infringement is blatant, wilful or at scale, including where a Customer Platform consists substantially of infringing material, redistributes live broadcasts or events without license, or is operated primarily to circumvent this policy.

9.6 Notice. We will tell you on each strike: what was removed, your strike count, when that strike expires, the threshold, and how to counter-notice.

9.7 Evasion. A Customer terminated under this policy may not open a new Account, or operate through another Account, without our written consent. Accounts opened in breach may be terminated without notice or refund.

9.8 Records. We record each notice, the action taken, the date, each strike recorded or withdrawn, and each termination, and retain those records for 7 years.

9.9 No waiver. Not acting on a particular notice does not waive our rights under this policy.
